...and smart business is to ask a women if she's married and plans to have kids in the next two years but the laws say that's discrimination too. All I'm saying is how it's amazing none of these restaurants are getting in hot water given the obvious hiring practices. Being a server is a very common job and it would be difficult to argue that being attractive and slim is mandatory if you want to work there.

Today the scales have tipped way too much in favour of employees. I am an owner of a company and it absolutely pisses me off everytime I have to call my lawyer before I fire anyone.
If you are a good employee and make lots of money for me I will pay you a lot of money. If you are not then I should be allowed to fire your ass period. If you are going to have babies in the next few years after I have spent a ton of money training you ... and then you get to go away for a year and come back to the same job ... I should have the right not to hire you .... PERIOD.
So in my business which requires a university degree and then a post graduate degree ... would someone be able to claim discrimination because we hire only candidates with very good grades????
Why the hell shouldn't a restaurant be allowed to only hire good looking employees. Heck if they want they should be allowed to hire only good looking blonds with big breasts. Actually that would make a great new concept ....
Earls Joeys and those restaurants are today's strip clubs. Speaking of strip clubs back when they were the place to go for a power lunch there weren't any fat strippers.
I believe there was someone who threatened to go to the human rights tribunal over the hiring practices of Earls. Don't know the outcome.
And I've gotten too off track so I wont start talking about the human rights tribunal.
