Getting "reno-victed" in Vancouver

Talked to my brother in the last couple of days and he is getting "reno-victed".He moved into the place in February and I can only think he signed a one year rental contract.Not 3 months later his landlord wants him/them out because he intends to renovate the home.The rent was a disgusting $2800 a month and the landlord now figures he can get more but he cant break the lease under the law so he is using technicalities to get my brother out of the place.

Get him out and give the place a coat of interior paint and then rent it for say $3600.....man that is fucking dirty....it is evil and greedy not to mention underhanded.

The highest my mortgage payment I had was $689 when I was saddled with a 6.89% interest rate for 3 years when I bought my home....in those 3 years I made the payments AND saved up enough to get 25% equity and remove CMHC from the picture.....after that life was a walk in the clouds.

I cant fathom paying $2800 a month in RENT......sadly the only way my brother will ever OWN a house is if he wins the lottery.

So glad I dont live on the Left Coast.

A lease is a binding legal document.....if it is signed by the legal owner, and the person who signed it still resides there, they can fight it until the lease has expired.
Evicting someone isn't as easy as some think, unless of course the shack is condemned, or otherwise deemed uninhabitable by the city.

Sometimes buying a used motor home and living at a Wallmart parking lot doesn't sound so bad.

if the lease is a legal lease...... then the landlord has to obey by it.

Make sure your brother calls Residential Tenancy Branch and gets aware of his rights. There are lots of protections in place.
If it's really a 1-year fixed term, I don't believe this would be allowed.

Even if allowed, the minimum notice is 2 full months (sometimes more) and he gets the last month free as a compensation. Also he could be able to move out sooner on a short notice (like 10 days), not penalized for it, and still get his 1 month compensation. Also if 5+ units are repaired, the landlord must offer him the place back after the repairs, and there is more compensation if the landlord fails to. Also there may be extra bylaws. Not sure if Vancouver has anything; I heard in Burnaby mass renovictions require 4 month notice and 3 month free rent.

The rent situation in Vancouver improved somewhat recently, so chances are, there are better choices. There may be more options in the summer.

Times have changed. People are downsizing their assets, less CD/DVD, more cloud/Terabyte drives, an pad/laptop. Going mobile with RV/campers for travelling.... Next big thing will be highrises that park RVs as land prices go up as you need more room for RV parks etc. After all they don't make any more land. Maybe houseboats....

One Walmart I know of that had been quite permissive about overnight campers changed their policy because people were turning the Walmart parking lot into quasi-permanent residences. Some literally put their RVs up on blocks and settled in for the long term. I think the last straw was when the Walmart manager had to call in a hazmat team to take care of a spill from some beat-up old rig.

It's too bad. When travelling, overnight stops at Walmart were a great option for those who just wanted a place to stop and sleep, and didn't need RV park facilities. Many Walmarts in the western states are still open to overnight stops, but not so much in Canada.

Have your brother check with his local tenancy branch for direction and what the laws would be in his circumstance. I'm looking at some of the answers above and they may be true for some areas but are definitely wrong for others.

I wanted to paint one of my rentals....the renter did it for me, and I supplied the paint.
The guy ended up installing new trim casings on the doors and windows, and new baseboards as well, I just supplied the trim and tools.
That guy got three months rent for free, and did a pretty good job...and I was happy to do it.

This sounds like what happened recently with the Whitehorse Walmart parking lot...

Sounds to me like your mortgage is going to be renewed soon if you went with a 5 year term.If not you can renew a mortgage anytime actually.Go see a mortgage broker and ask them to "hang the paper on the wire" so to speak.Most likely the bank you are dealing with will pick up the paper.When going through the details state specifically that you have over 25% equity and you want CMHC out of the picture.I also suggest playing with a mortgage calculator and adjusting the ammortisation time frame....say instead of 25 years down to say 12-15 years for when you renew the mortgage....yes your monthly payment may go up but if you get a better interest rate that off-sets it as well.

I myself went from a high ratio mortgage via Exceed when I bought my home in 2003 and I was paying 6.89%.I made all of the payments and saved up enough that when I renewed the mortgage I got CMHC out of the picture and the TD Bank picked up the paper for a rate of 4.95% and with the extra equity in I changed the term of ammortisation to 12 years and doubled my monthly payments for 2 years.

Truth be told if you buy a 500,000 home and even get low interest rates if you take 25 years to pay it off that 500,000 homes is going to cost you over 1 MILLION because of how mortgages are structured.

Funny enough when my mortgage came to term and it was time to renew well Exceed just figured I would be renewing with them.When it went through the legal stuff the company contacted my lawyer and said I had to pay a penalty.My lawyer tore them a new asshole and bluntly said....."the mortgage was paid to the term and my client has not renewed with your firm...alternate financing is in place and my client aint paying you jack shit....now go piss up a rope".....well it was more polite actually.

Major renovations requires that the permits to do the work are already in place (so it means major), and 2 months notice needs to be given.

I've been to the RTB many times with a previous landlord who wanted me out (I was locked in at $3500/month and the other units in the building had gone up to $8500+ per month). I one every time. He literally had to sell the place and the new owners had to move in for me to have to leave).

Walmart gets a lot of deliveries overnight, in older or smaller rural stores RV's don't realize there blocking the receiving docks. I was in Thunder Bay ON last month and 3 RV's had everything blocked off and 5 trucks waiting to unload, the cops had to be called and things got ugly.
