Adult advertising

Thanks for your focus on the advertising issues raised by C-36, CAEC. That was at the heart of my OP. It's good to understand that for many SPs it's almost business as usual. But the fact is that an entire advertising medium has been closed - i.e. print media - for adult services, by C-36. While the law will ultimately be tested through the courts in the long term, C-36 proponents have disabled significant access to adult services. That was the true intent of the bill. Laws were already in place to prosecute criminal providers. While ultimately it may be shown that newspapers and internet search engines are immune from prosecution under C-36, most are not prepared to take the risk of carrying adult advertising. CAEC is correct in noting that these issues do not seem to be closely followed now, although many campaigned strongly against the bill before its passage. Those campaigners continue to do good work, but SPs who post that all is well because BP or CL or regular clients etc. remain available, are missing the point. Diminished advertising channels are a threat to the socially important adult services industry.


It's good to hear current info from Victoria SPs. There was discussion out of Vancouver as well with mixed comments about business being up or down.

As for the advertising question, the Conservative who was selling Bill C-36 in the House of Commons said sex workers would have the same ability to interact with other Canadians that any other Canadian has. That will matter to the courts if the police anywhere try to go after an advertising agency. It seems an advertising service provider such as Now Magazine, the Georgia Straight or a web site service provider would not be considered an advertiser but rather, a distributor of someone elses advertising. Only the party with authority over the content, distribution and response to advertising would be considered an advertiser under C-36.

This would explain why there has been no action against Now Magazine, the Georgia Straight or a web site service provider but there have been charges laid against an agency caught working with a minor and some individual "pimps". We will need to see how those court cases are handled but it seems no one is following them closely.
