Why newsgroups and not torrents?

There is some legal difference between a newsgroup and a torrent. With a torrent you are sharing data. With a newsgroup you are only downloading it. For some types of content (e.g. music) this can be a huge difference legally, as downloading music from a newsgroup I would guess to be deemed legal under current Canadian law. Sharing music on the other hand may not be as legal. For software either way is probably illegal but just by simply downloading I am sure the repercussions would be less than sharing it out to who knows how many people.
