How much notice do I need to give?

Hi,

Is anybody very familair with the employment standards act. I recently accepted a new job and have been there about 5 weeks now. The thing is I hate it, it's not what I expected at all.

How much notice do I need to give if I decide to quit?

On the job offer letter which I signed there is a clause which says that "if either party wishes to terminate this agreement, a termination notice must be given to the other party at minimum 21 days prior to the termination date".

Even though I have been there only 5 weeks, am I bound by this clause.

approach your employer and tell them the truth ... they may not want you to be around for 21 days or may hold you to that until they find a replacement.

you probably won't want a reference from this company and wouldn't put them on your resume so give what you consider is reasonable notice, pack your stuff and start looking for another job.

they cannot with-hold pay etc. that is covered under the employment standards act ... the 21 day clause is really not enforceable.

two weeks is the usual 'polite' notice ...

quitting outright is not unheard of ...

Nor is starting a job, going for coffee break then just not coming back. Seen that before too.

If you look at the ESB website, you'll see that, although if an employer terminates you, they have to give you notice or pay wages in lieu, an employee can simply up and quit. Period.

Of course, burning bridges means you can kiss goodbye the chance of getting a letter of recommendation from them.

It's a little different in Manitoba. One is required to give 2 weeks notice if they have been on the job for at least 3 months. Otherwise you can quit anytime and they can fire you any time.

I have always been upfront with my employers. Like Oldfart says, one really doesn't want to burn their bridges.

In the lunch room, make obscene gestures and phrases and make them with a straight face. They'll send you to a doctor and he'll diagnose you with terrets syndrome. Either they'll give you a settlement, perminant disabled status pension, or they'll let you stay and you can tell anyone off and sexually harrass anyone in the office and they will tolerate it. :)
