Cops need to use common sense. As this could actually encourage people to drive drunk.

Due to liability concerns police have to be fairly strict on this issue.
Imagine a drunk driver killing a couple of people in a collision. Then it is revealed that a police officer had stopped and checked him a few minutes before. The cop let him go because he "promised to drive straight home".
The cop's career would be over and the city would be in for a lawsuit.

a friend at work got charged it was thirty below out side, he was to drunk to drive but he was asleep in his car with it running,

here is a weird one an rcmp charged a friend with having booze in his back seat, booze in a bag and sealed.
but as it turned out nothing, the friend was waiting for a specialty wine that never came in so he left the store with nothing,
but the cop was a prick, my friend just snickered and laughed, and said I will take you to court, it was a bag of dog food in the back, and the liquor store owner gave a statement to the effect he never actually bought anything.

When I was a teen, my friends and I ran out of Gas at a Texaco station just outside of Moosomin Saskatchewan. We had a trunk full of beer, but had slept in the car while waiting for the station to open. We had pushed the car off the Hwy and into the station. RCMP officer checks us out just before the station opened "too bad the car won't run on beer". Then the RCMP officer parked himself on the Saskatchewan / Manitoba border for the "easy" ticket. In Saskatchewan it's legal to have opened cases in the Trunk, in Manitoba it's illegal to have opened cases in the car. We had breakfast and then lunch at the station's restaurant until he gave it up as not so easy after all and headed back towards Regina. We gave away the beer from the opened cases to people at the restaurant.
