I see that Ella in Nanaimo is advertising that she wishes to see only men under 65. At one time Audrey also had an upper age limit.

This looks like a question for alaninburnaby. Could one, if he had the balls, pursue a case of illegal age discrimination?

There must be others in this age category who are curious about this point.

Would you really want to have sex with a lady if she doesnt want you.
Sure we are paying, but they can still see who they like.

I cant see how you could ever have a legal case, where your goal is rape.

A lady is free to chose with whom she has sexual relations. Just pass over said lady in question and find one that'll cater to your needs. If a lady doesn't want to fuck you, she doesn't want to fuck you. End of story. Pressing further and harassing her for not wanting to have sex with you just makes you a douche. Be a gentleman and move along, you're sure to find a gem elsewhere.

The relevant legislation would appear to be subsection 8(1) of the Human Rights Code, and I have bolded the passages that would seems to be the points of contention in any proceedings associated with sensualsixty's query:

8(1) A person must not, without a bona fide and reasonable justification,

(a) deny to a person or class of persons any accommodation, service or facility customarily available to the public, or

(b) discriminate against a person or class of persons regarding any accommodation, service or facility customarily available to the public
because of the race, colour, ancestry, place of origin, religion, marital status, family status, physical or mental disability, sex, sexual orientation or age of that person or class of persons.

From a theoretical perspective, sensualsixty might have a point, but the key issues are that you have to prove:
(1) she sells sex, then define what is legally for sale to the general public
(2) prove that the reason she isn't selling the same to you is because of your age

Discrimination is tough to prove. The day a fat ugly girl gets a waitress job at Earl's is the day before a senior citizen wins a court case to get sex from a prostitute. The fact that what she sells is not written in a legally binding contract alone probably sinks the case.

But assuming the near-impossible odds that this goes to court and you win, how do you enforce it? Who comes with you to the bedroom to make sure penetration occurred?

From a practical standpoint, why do you want to be with a woman who requires a legal injunction to be with you? There are enough SPs out there who service all ages without having to worry about those who do not.

I hope I'm a little more chill about this when I become a dirty old man lol.

I thought that this might prompt interesting responses, and I was correct. When contacting an SP one of my first questions is "are you comfortable with an older man?" I have been pleasantly surprised by the number who have said "I prefer older men". When with an SP client age is often a discussion topic, and I usually turn out to be a kid, compared to some of the other clients. Listen up, you young guys with worries about getting old(er).

An independent business person should have the right to refuse to do business with any individual or organization she or he so decides.

I employ age discrimmination when selecting a service provider. I'm old enough to be uncomfortable with anyone under 30, so I stay away from those providers who advertise a younger age.

There are lots of guys on PERB who choose not to see older women. I do too, but my upper limit is kind of fuzzy, somewhere between 50 and 60.

We clients get to choose who we see, and the providers have every right to do the same.

Any case you try to bring before a judge regarding age discrimination associated with a sexual partner would be laughed out of court.

Haven't any of you heard the "no means no" rule? Women are perfectly entitled to turn down any man who wants to have sex with them for any reason.
Ordinarily, but since in this case they are providing a service, technically they could be in violation of the human rights code. It would be the same as going to a store and being denied service. The complication of course is that because of the laws surrounding prostitution, when you visit an escort you are paying for her time, not for sex. And you can't file a human rights complaint for being denied something that is illegal. I guess if you wanted you could sit and talk to her for the hour, but any sex would have to be at her discretion because you are not paying for that. She wouldn't be able to say no to social time since that is what she is contracting out for, but I doubt many clients would be willing to fork over $$$ knowing that, so they would just leave. And of course, if it was clear that was the situation it would be as umcomfortable as fuck, so why would anyone pay to put themselves through that?

That would change if prositution and surrounding activities did become legal however. Then it would be legally the same as any other service offered and subject to the same regulation. It would be interesting to see how judges would handle that if any such complaint was made.

Enforcement in discrimination cases usually takes the form of damages, so it would be monetary award.

The clients of a service are not subject to those sorts of claims though, only the service provider is, since they are the ones publically offering the service.

Someone providing a service is not obliged to provide the service under any circumstances, but the circumstances they use as a reason cannot be those protected under law. For example, if you routinely supplied services to black people for example, the denial of service to someone who happens to be black wouldn't be grounds for a discrimination claim since it would not be that fact alone that caused you to deny service (based on prior history).

I understand that everyone has their own restrictions, however i think that its better said and left to talk about it in private.
I have my own restrictions but id preffer to keep them private.
IT does in my opinion come across a bit off...... that is to publically advertise that you will not see a client because of his age.
Alot of us are not even the age we advertise...
for example I look young, and i am youthful. I eat well i take care of myself i have no wrinkles... I can pass for anywhere between 22 to 25 but im older. I think before anyone discriminates against a clients potential age.. we escorts as a community should be honest as well.

SINCERELY TRUE

I have said this before, and will say it again, I reserve the right, to refuse service, to anyone, at any time, for any reason. IMHO, trying to get this issue " of age discrimination" before the courts in regards to a pooner wanting to seen an SP is laughable at best. I fuck who I want to fuck, plain and simple. Just because you ask, doesn't mean you will get it ;) After all, it is MY body, and my house. End of story
shouldnt you be a paid advertiser to talk about fucking anyone ??????

There are just so many available options for who to see and where to spend your $$. If they want to say they don't want to entertain your age group, so be it.

I wouldn't even waste my time trying to convince them otherwise.

A court case?? Really? Talk about wasting valuable court time with a nonsense case.

Why would anyone in his right mind want to take an sp to court, sounds like a huge waste of time & money.Sure got all the sp's fired up though, to me this seems to be the ops only objective.
I don't have an opinion one way or the other about the subject, other than some peoples buttons are a lot easier to push than others.
